Stamp duty in Uttar Pradesh — rules, rates, and a free calculator

Uttar Pradesh has one of the highest lease rates among major states — 2% of the total rent — though the refundable deposit stays out of the base. For Noida and Lucknow rentals this makes proper stamping noticeably more expensive than in Delhi next door, and under-stamping correspondingly riskier.

How Uttar Pradesh computes it

Rent & lease agreements

Uttar Pradesh levies 2% stamp duty on the total rent for the term; the refundable security deposit is exempt from the duty base. The security deposit is exempt from duty. Registration is optional for agreements below 12 months; longer leases attract compulsory registration.

Reference example — ₹25,000/month, 11 months, ₹1,00,000 deposit: duty ≈ ₹5,500 (total ≈ ₹5,500).

NDAs & general agreements

A flat ₹100 under UP Schedule I, Article 5. This covers NDAs, service agreements, and most contracts without their own schedule entry.

Why it matters

An under-stamped agreement is inadmissible as evidence (Section 35, Indian Stamp Act, 1899) and can be impounded, with a penalty of up to 10× the deficit under Section 40. Stamping correctly at execution costs a fraction of fixing it during a dispute.

Uttar Pradesh stamp duty FAQs

How much is rent agreement stamp duty in Uttar Pradesh?

Indicatively 2% of the total rent for the term. For ₹25,000/month over 11 months that is about ₹5,500. The refundable security deposit is exempt from the duty base.

Is a Delhi-style ₹50 agreement valid in Noida?

No. Noida is in Uttar Pradesh, where the 2% ad-valorem rate applies — not Delhi’s flat ₹50. Using a Delhi template for a UP property is one of the most common under-stamping mistakes in the NCR.

What does an NDA cost to stamp in Uttar Pradesh?

A flat ₹100 under Schedule I, Article 5 as adopted by UP.
