Why this keeps happening

Nobody means anything by it. Asking for paper between people who trust each other feels like an accusation — so the loan, the job, the rent and the repair all live in memory and a few messages. It works, most of the time, which is exactly why it keeps happening.

Then a month becomes a year, and there is nothing on the table to settle it: no amount, no date, no what-happens-if. The relationship ends up carrying a weight that one page would have carried instead.

You say what is happening in your own words; the page says it in the words that hold. Writing it down is not distrust — it is the kindest thing you can do to a friendship, so this stays a friendship and not a follow-up.

Why this keeps happening

The person across the table may be signing for someone else, may not own what they are letting, or may be exactly who they say they are — and there is usually no way to tell. So everyone guesses, and hopes they guessed well.

The guessing is what makes people hold back. An owner leaves a flat empty rather than hand keys to a stranger; a shopkeeper turns down an order from a buyer he cannot place. Trust that cannot be checked simply does not get extended.

Enterprise e-sign verifies one party — the company’s customer. Nobody verifies both, for two people.

Both of you verify with Aadhaar before a word is signed, and both of you see who the other turned out to be. Not a background check run on a stranger — an introduction that still stands up a year later.

Why this keeps happening

The people this happens to did the harder thing already — they wrote it down. What nobody told them is that a page becomes evidence only when the right duty has been paid, in the right state, on the right instrument, and that a photograph of a signature travelling through a chat is not a signature anyone has to accept.

It surfaces at the worst possible moment. The paper that was supposed to end the argument becomes the argument.

The right duty for the right state, paid before you sign, in the states we support — and then Aadhaar eSign, so the signatures hold under the IT Act 2000 rather than in somebody’s photo gallery.

Why this keeps happening

The arithmetic ends the matter before it starts, and the sensible thing — the thing almost everybody does — is to let it go and remember it.

That quiet writing-off is the real cost, and it is not one court’s backlog. It is millions of people deciding, one at a time, that what they are owed is not worth the queue. Each decision is reasonable on its own; together they are the trust deficit.

About 35 lakh of them are cheque-bounce cases alone (Supreme Court of India, 2020).

Why this keeps happening

The other person reads a page of clauses they have no way to price, in a language built for a courtroom, with the pen already in their hand and the room waiting.

So they sign, and hope the terms never matter. Usually they don’t. The times they do are the times the person with less was already carrying more.

Fair defaults, drawn from clauses lawyers have reviewed, so neither side has to negotiate the obvious. And before anyone signs, both people read the same one-screen summary, in the same plain words.
